The terms you're agreeing to.
These terms govern your use of Top View Property and explain exactly how reserving a unit works — what a reservation does and does not secure, and what happens to your deposit.

Who you are dealing with
This website is operated by [registered name — to be confirmed], trading as Top View Property, of [address — to be confirmed]. You can reach us at hello@topviewproperty.ai.
These disclosures are provided in terms of section 43 of the Electronic Communications and Transactions Act, 2002.
What we are, and what we are not
We are a marketplace. Developments listed here are built and sold by third-party developers, and the sale agreement you eventually sign is between you and that developer, not with Top View Property.
We publish information supplied to us by developers — prices, unit availability, plans, renders and completion expectations. We take care to present it accurately and to mark clearly where a figure is an estimate rather than a confirmed fact, but we do not independently guarantee a developer's construction timelines or the finishes of a completed unit.
Nothing on this site is financial, tax, or legal advice. Get your own before committing to a property purchase.
Reserving a unit
Reserving is a two-step process, and the distinction between them matters:
- The hold. Selecting a unit places a short, temporary hold on it, and we show you the exact time that hold expires. During the hold nobody else can reserve that unit. The hold costs nothing and commits you to nothing.
- The deposit. Paying the reservation deposit converts the hold into a reservation, and the unit is taken off the market in your name while your application proceeds.
If the hold expires before the deposit is paid, the unit is automatically released back into available inventory and may be reserved by someone else. No charge is made and you are free to try again if it is still available.
Your deposit
The reservation deposit is refundable. It secures the unit while your application is assessed; it is not a payment towards the purchase price and it does not by itself create a sale.
A reservation does not guarantee that your purchase will complete. It remains subject to your FICA verification, your bond approval where you need finance, and the signing of a sale agreement with the developer. If the purchase does not proceed for a reason that is not your fault — bond declined, or the developer withdrawing the unit — your deposit is returned in full.
Refunds are paid back to the account the deposit came from. Where you are entitled to a refund, tell us and we will process it without requiring a reason.
FICA and your documents
South African law requires identity and address verification before a property transaction can be processed. We will ask you to upload documents such as your identity document, proof of address, and — where you are applying for finance — payslips and bank statements. We cannot progress an application without them.
How those documents are stored and who can see them is set out in our privacy notice.
Your account
You are responsible for what happens under your account and for keeping access to your email address secure, since that is how we verify it is you. Tell us immediately if you think someone else has access.
We may suspend an account being used fraudulently, to make reservations with no intention of completing them, or in a way that disrupts the service for others.
Availability
We work to keep the platform available and accurate, but we do not promise uninterrupted service. Unit availability in particular changes in real time, and a unit shown as available may be reserved by someone else moments later. Availability is confirmed only once your hold is placed.
Your rights as a consumer
Nothing in these terms limits any right you have under the Consumer Protection Act, 2008, the Electronic Communications and Transactions Act, 2002, or any other law that cannot be contracted out of.
Governing law
These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.
Changes
We may update these terms. The date at the top shows when they last changed, and material changes will be brought to your attention rather than made quietly.
